By booking with Resort to Laura Madrid, you (“Customer”) agree to the following Terms of Service. Resort to Laura Madrid reserves the right to change these Terms of Service at any given time. Please check our website frequently to see the most updated Terms of Service.

COVID-19

Due to COVID-19 or other unforeseen pandemics, by booking a trip with Resort to Laura Madrid you acknowledge and fully understand that your travel arrangements may be interrupted or canceled by the associated travel supplier, a government entity, or another third party outside of our agency's control for reasons that are unforeseeable at this time. You also understand and acknowledge that travel involves the risk of a variety of hazards to health and/or safety, including but not limited to, injury, illness, disease, epidemics, and/or pandemics. Resort to Laura Madrid is not responsible for any risks associated with travel whether or not specified herein. The agency has no control over the associated supplier's policies which, in addition to applicable law, will solely govern any cancellation, rebooking, and refund related to these travel arrangements.

Safety & Risks

Travel to certain destinations may involve greater risk than others. Resort to Laura Madrid recommends customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov,http://www.tsa.govhttp://www.dot.govhttp://www.faa.govhttp://www.cdc.gov and http://www.cbp.gov.

Resort to Laura Madrid does not represent or warrant that travel to certain destinations is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from such travel. Customer’s participation constitutes acceptance of such events at customer’s own risk.

Travel Documents

Customer is responsible to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that passengers carry at least two forms of acceptable identification. The name, date of birth and gender that appears on the identification card must exactly match the data listed on airline ticket(s) and booking records. Certain countries will not admit a passenger whose passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. Resort to Laura Madrid is not responsible for lost payments due to invalid or unissued travel documents (identification card, passport, visa). Please note that USA rules regarding entry and exit change on a daily basis.

Children and infants also require all such travel documents. The U.S. Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.

Health Requirements

Customer is responsible to have proper immunizations and required documentation of such immunizations before travel. Resort to Laura Madrid shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. Required inoculations must be recorded by Customer’s health practitioner on a valid vaccination certificate, which Customer must carry for proof of inoculation. Check the USA State Department website http://travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control http://wwwnc.cdc.gov/travel relating to health issues.

Payments & Cancellation

Resort to Laura Madrid acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not subject to the control of Resort to Laura Madrid. Customer agrees to abide by the terms and conditions of purchase imposed by Resort to Laura Madrid and any third-party supplier. Final payment is due prior to departure according to each supplier’s terms and conditions. Customer understands that if terms and conditions are violated, reservations are subject to cancellation and penalties will apply. All payments are non-refundable. Customer shall be completely responsible for all charges, fees, duties, taxes, and assessments for travel bookings organized by Resort to Laura Madrid.

Independent of supplier cancellation policies, Resort to Laura Madrid reserves the right to charge client a cancellation fee equivalent of 10% of the total trip cost based on the products we have booked for you. This fee compensates us for lost commission revenue as a result of the cancellation and will be charged to client card on file in the event of cancellation. Postponed trips will not incur a cancellation fee.

Potential Price Increase & Currency Fluctuations

Resort to Laura Madrid will endeavor to provide customer with accurate pricing and explanations of cancellation policies, however customer agrees that Resort to Laura Madrid will not be liable in the event of unforeseen price changes or changes in cancellation policies. Further, by quoting prices to customer Resort to Laura Madrid is not warranting that no lower price exists, but only that the price quoted is the lowest price known to Resort to Laura Madrid. Currency exchange rates fluctuate on a daily basis and quoted prices are subject to change.

Air Travel

Resort to Laura Madrid shall not assume responsibility for any air and/or ground schedule changes. Failure to use a reservation may result in automatic cancelation of all continuing and return flights, as well as forfeiture of airfares. Due to enhanced security, it is recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. It is recommended that Customer reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights and 72 hours prior for international flights. Certain countries require departure taxes to be paid in cash upon departure.

Travel Insurance

Resort to Laura Madrid offers access to services that enhance every travel experience. Travel insurance protects Customers and their investment. Unless specifically noted, travel insurance is not included in the cost of the customer’s itinerary. Without appropriate travel insurance, Customer understands and agrees that if Customer cancels or interrupts travel for any reason, portions of the trip/tour may not be refunded and cancelation penalties will apply, resulting in the loss of monies up to the full cost of Customer’s travel booking and related costs. Resort to Laura Madrid is not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage.

Limitation of Liability

Resort to Laura Madrid does not own or operate any entity which is or does provide goods or services for trips including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional or included excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, Resort to Laura Madrid is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, Resort to Laura Madrid is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience (collectively, “losses”) in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, financial insolvency, default or cessation of services by suppliers, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as horseback riding, scuba diving, zip lining, snorkeling, paddle boarding, surfing, swimming, kayaking, sailing, canoeing, whitewater rafting, hiking, bicycling, rappelling, canyoning/canyoneering, fishing, snowshoeing, cruising, camping, helicopter tours, 4×4 Jeep/ATV tours, snowmobiling activities, hot air ballooning, jetboating, mule riding, dogsledding, cross-country skiing, rock climbing, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, quarantine, illness, epidemics or the threat thereof or for any other cause beyond the direct control of Resort to Laura Madrid. By agreeing to these terms Resort to Laura Madrid is released of all liability and assumed risk.

Assumption of Risk

Customers are aware that adventure travel involves hazardous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Resort to Laura Madrid, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. Be aware that weather conditions may be severe, adverse and/or unpleasant. Medical services or facilities may not be readily available or accessible or consistent with standards in the United States during some or all of the time during which customer is participating on adventure travel and that when available may not be of the quality which exists in the United States. In order to partake of the enjoyment and excitement of this adventure travel trip customer is willing to accept the risks and uncertainty involved as being an integral part of the adventure including without limitation the specific risks associated with the activities that are a part of the trip. Customer accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Resort to Laura Madrid and agree to hold harmless and release Resort to Laura Madrid from claims of third party negligence.
